Intellectual Property & DMCA Policy

PIM Marketplace respects intellectual-property rights and expects users to do the same. This policy explains how to report copyright infringement (under the U.S. Digital Millennium Copyright Act, "DMCA"), trademark infringement, and counterfeit goods, and describes our notice-and-takedown and repeat-infringer procedures. It is part of our Terms of Service.
1. Designated DMCA agent
Send copyright notices to our designated agent:

You must also register a DMCA agent with the U.S. Copyright Office (dmca.copyright.gov) to receive the statutory safe harbor. Complete that registration and confirm the agent details above before publishing.
2. How to report copyright infringement
If you believe content on the Services infringes your copyright, send a written notice to our agent that includes:
- A physical or electronic signature of the owner or a person authorized to act on the owner's behalf;
- Identification of the copyrighted work claimed to be infringed;
- Identification of the material claimed to be infringing and information reasonably sufficient to locate it (such as the listing URL);
- Your contact information (address, telephone number, and email);
- A statement that you have a good-faith belief that the use is not authorized by the owner, its agent, or the law; and
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on the owner's behalf.
Misrepresenting that material is infringing may subject you to liability. Upon a valid notice, we will remove or disable access to the material and take reasonable steps to notify the affected user.
3. Counter-notice
If you believe your content was removed by mistake or misidentification, you may send a written counter-notice to our agent that includes:
- Your physical or electronic signature;
- Identification of the material removed and its prior location;
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
- Your name, address, and telephone number; and
- A statement that you consent to the jurisdiction of the federal court for your district (or, if outside the U.S., Los Angeles County, California) and will accept service of process from the party who filed the original notice.
If we receive a valid counter-notice, we may restore the material in 10–14 business days unless the original complainant notifies us that they have filed a court action.
4. Repeat infringers
We will, in appropriate circumstances and at our discretion, disable and/or terminate the accounts of users who are repeat infringers, and may remove listings and withhold payouts associated with infringing activity.
5. Trademark and counterfeit reports
To report trademark infringement or counterfeit, replica, or otherwise unauthorized goods, email admin@pim-pro.com (or admin@pim-pro.com) with: your identity and the rights holder you represent; the registered mark or right at issue; the specific listing(s) or content; and a good-faith statement that the use is unauthorized. Selling counterfeit or infringing goods violates our Acceptable Use & Prohibited Items Policy and may result in immediate removal, withheld payouts, and account termination.
6. Our intellectual property
The PIM Marketplace name, logo, and the Services are protected by intellectual property laws as described in the Terms of Service. Reporting infringement of third-party rights does not grant you any rights in our marks or the Services.
